Unfair competition

Any person who wilfully competes unfairly in terms of Articles 3, 4, 5 or 6 shall on complaint be liable to a custodial sentence not exceeding three years or a monetary penalty.50

Any person who has the right under Articles 9 or 10 to bring civil proceedings may file a criminal complaint.

The Confederation has the rights of a private claimant in the proceedings.51
