A life annuity may be created for the lifetime of the annuitant, the grantor or a third party.

In the absence of any specific agreement, the presumption is that it is settled for the life of the annuitant.

Unless otherwise agreed, an annuity settled for the life of the grantor or of a third party passes to the heirs of the annuitant.
